Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of IndieFame ("IndieFame," "we," "us," or "our"). By accessing or using the service, you agree to these Terms. If you do not agree, do not use IndieFame.

These Terms apply to IndieFame services accessed through any IndieFame-owned domain or subdomain, including indiefa.me and app surfaces operated by IndieFame. If you use or access IndieFame on any such domain or subdomain, you are accepting these Terms, and it is your responsibility to review the current version of these Terms before continuing to use the service.

2. Accounts and Eligibility

You must be at least 18 years old and able to form a binding agreement to use IndieFame. If you use IndieFame for a company, client, or other organization, you represent that you have authority to bind that organization to these Terms.

You are responsible for providing accurate account information, maintaining the security of your login methods, devices, browsers, and sessions, and for all activity that occurs under your account.

3. Submissions, Billing, and Usage Limits

Paid features may require an active subscription, usage allowance, credit balance, listing fee, or other paid entitlement processed through our payment providers. Subscription fees are billed in advance and may renew automatically unless you cancel before the next renewal date.

If IndieFame offers credits, limits, usage meters, trials, or promotional grants, they are service entitlements only. They have no cash value, are not stored-value instruments, cannot be transferred, and are not refundable except where we decide to correct a genuine billing error or where required by law.

We may change plans, prices, included usage, feature access, billing mechanics, listing mechanics, verification requirements, or payment-provider requirements. If required by law or provider rules, changes will apply after appropriate notice or at the next billing cycle.

4. User Content and Rights

You may upload, import, submit, store, and use product details, logos, files, URLs, website data, profile data, categories, discounts, verification materials, drafts, listings, and related materials ("User Content"). You retain any rights you have in your User Content.

You grant IndieFame a worldwide, non-exclusive, royalty-free license to host, store, copy, process, transform, transmit, display, and use User Content as needed to provide, secure, moderate, support, improve, and operate the service.

You represent that you have all rights, licenses, permissions, and consents needed for the content you upload, import, reference, submit, verify, or publish. You are solely responsible for ensuring your inputs and listings do not violate intellectual property, privacy, publicity, platform, advertising, consumer-protection, or other applicable rights and laws.

5. Directory Listings and Commercial Use

IndieFame may review, classify, approve, reject, edit visibility, or remove product listings, drafts, logos, verification requests, and related materials for quality, safety, legal, provider, payment, or platform reasons.

We do not guarantee that any listing is unique, protectable, non-infringing, compliant with third-party rules, commercially effective, eligible for approval, or fit for a specific purpose. You must review and approve all information before submitting or relying on it.

You may use IndieFame for commercial purposes only if you have independently confirmed that your submissions, claims, trademarks, logos, references, account data, and final listings are lawful and properly licensed for that use.

6. Third-Party Services

IndieFame may link to, reference, or depend on third-party websites, product pages, social platforms, DNS providers, badge placements, payment providers, storage providers, hosting providers, analytics providers, authentication providers, email providers, support providers, and other services.

IndieFame depends on third-party providers for authentication, hosting, databases, storage, analytics, billing, email, support, and verification workflows. Their outages, policy changes, provider restrictions, pricing changes, or enforcement actions may affect IndieFame features.

7. Moderation and Prohibited Activities

We may scan, classify, reject, block, remove, or restrict content, uploads, verification activity, listing requests, and account activity to enforce safety, legal, provider, payment, or platform rules. Moderation systems can produce false positives or false negatives, and we are not required to provide a detailed explanation.

You must not use IndieFame to:

• Break any law, regulation, contract, or platform policy.
• Infringe intellectual property, privacy, publicity, image, likeness, or confidentiality rights.
• Submit hateful, harassing, abusive, defamatory, deceptive, violent, sexual, exploitative, extremist, or otherwise harmful content.
• Impersonate people, brands, public figures, private individuals, or organizations without proper rights and consent.
• Make false product, medical, financial, political, legal, advertising, or endorsement claims.
• Scrape, crawl, overload, reverse engineer, bypass security, abuse billing or usage limits, resell access, or interfere with the service.

8. Service Availability

We do not guarantee uninterrupted access, successful verification, provider uptime, fixed processing times, listing approval, product visibility, search ranking, directory traffic, conversions, revenue, or continued availability of any feature. We may modify, suspend, or discontinue any part of the service at any time.

9. Intellectual Property

IndieFame, including its software, design, workflows, templates, branding, documentation, and platform content excluding your User Content, is owned by IndieFame or its licensors and is protected by applicable intellectual property laws.

You may not copy, adapt, reverse engineer, or exploit the service except as allowed by these Terms. Feedback may be used by IndieFame without restriction or compensation, provided we do not disclose your personal information in violation of our Privacy Policy.

10. Termination

We may suspend or terminate your account or access immediately if we believe you violated these Terms, created legal or security risk, abused the service, failed to pay, or used IndieFame in a way that may harm us, users, providers, platforms, or third parties.

You may stop using the service or request account deletion at any time. Termination does not automatically create a refund right.

11. Disclaimers

The service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, reliability, approval results, traffic results, or listing quality.

12. Limitation of Liability

To the maximum extent permitted by law, IndieFame and its owners, directors, employees, contractors, affiliates, licensors, and providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, loss of goodwill, business interruption, content claims, platform restrictions, rejected listings, failed verification, failed campaigns, or lost traffic arising from or related to your use of the service.

13. Governing Law and Changes

These Terms are governed by the laws of India, without regard to conflict-of-law rules, unless applicable law requires otherwise. We may update these Terms by changing this page and its "Last updated" date. Your continued use of IndieFame after an update means you accept the updated Terms.
